Lockerbie's Case Under International Law

This study examines the Lockerbie case and its ramifications under international law. The research problem explores whether the Lockerbie crisis was primarily a political issue created by Western nations to pass the policies of the new international order and enforce global dominance, or a purely legal matter governed by international laws and treaties. Utilizing historical, analytical, objective, and scientific methodologies, the paper reviews historical events and legal texts. The findings indicate that the crisis was shifted from a legal framework to a political one, violating the UN Charter and overlapping judicial jurisdictions, while highlighting that Libya's legal position aligned with international law and the 1971 Montreal Convention. The study recommends resolving crises through peaceful means, reforming the UN structure, and granting a greater role to the International Court of Justice.
